Steps to File an Auto Insurance Claim to Get Paid After a Car Accident in Las Vegas, NV

Nobody hopes to get into a car accident but car accidents do happen. When an accident happens what are the steps you need to take to ensure that you get the best outcome out of this difficult accident? Kajioka & Associates Attorneys at Law will go over a few steps you should do to file a car accident claim.

Call 911 After a Car Accident

The first step you need to do after an accident is to call 911. Even if you don’t think that you are injured or you feel like it was a minor accident, you should still call 911. If you do not feel like you are injured then you must go and help others who may be injured until the police and ambulance arrive. If possible, move your car to the side of the road, out of traffic. It is important to get your injuries checked out. You know you should check out the obvious injuries, like broken bones or wounds, but some injuries can occur a few days after such as whiplash. Even if you don’t think you are hurt it is smart to have the paramedics check you out or go to urgent care right after.

Do Not Admit Car Accident is Your Fault

Whatever happened you don’t admit fault. Even if it is partly your fault you may be eligible to recover damages. In a case that gets to a jury, they will review the evidence and determine the extent to which each driver was responsible. If you are 50% or less you may recover damages, but if it is 51% or more your fault you will not be able to recover damages. The police will ask you questions and you should answer them, but you can always say “I need to speak to my accident lawyer.”

Gather Evidence

If you can, get videos and pictures of everything that has happened at the accident. Make sure you take photos of the license plate, and driver’s licenses and get the make and model of the cars. Get the address, phone number, and insurance information from the other drivers involved. Also, write down the condition of the road and what the weather was like. If there are any witnesses get their information and their statement. Do not post anything online, this can do more harm than good.

Let the Insurance Company Know

Make sure you call your insurance company. Either by phone, online, or through their app you need to make sure your insurance company knows you have been in an accident. If you are in the hospital then make sure you have a family member that can call the insurance company for you. If you have an accent injury attorney, they can also contact them for you.

Do Not talk with Other Driver’s Insurance Company

There is a good chance you will receive a phone call or a letter from the other driver’s insurance company trying to offer you a settlement. Do not respond or reply. Let your car accident lawyer be the one to negotiate with your insurance company. They will present evidence to the insurance company so that you can receive compensation for your medical expenses, loss of wages, property damage, or pain and suffering.
